These Terms & Conditions (“Terms”) govern your access to and use of the Wish mobile application, website, and related services (collectively, the “Services”), operated by SoulWish Tech Pvt Ltd (“SoulWish Tech”, “we”, “our”, “us”). By using the Services, you agree to these Terms.

1. Eligibility

  • You must be at least 18 years old (or older if required by your local law) to use the Services.
  • You represent that all information provided by you is accurate and current.
  • You may use only one genuine account and must not impersonate others.

2. Account Registration & Security

  • You are responsible for keeping your login credentials and account secure.
  • You are responsible for all actions that occur through your account.
  • Notify us promptly if you suspect unauthorized access to your account.

3. Nature of the Service

Wish is a dating and social-discovery platform, including features such as profile creation, matching, messaging/chat, date requests, and interactive icebreaker/game-style experiences (including truth-or-dare-style prompts). We do not guarantee matches, responses, compatibility, or outcomes from user interactions.

4. User Conduct Rules

You agree that you will not:

  • Harass, abuse, threaten, extort, stalk, defame, or exploit other users.
  • Post or share illegal, harmful, violent, sexually exploitative, hateful, or deceptive content.
  • Share another person’s private/confidential information without consent.
  • Use bots, scripts, scraping, reverse engineering, or unauthorized automation.
  • Use the Services for fraud, spam, solicitation scams, or unlawful activities.
  • Attempt to bypass moderation, safety, or technical controls.

5. User Content & License

  • You retain ownership of the content you submit (e.g., profile data, photos, messages, prompts).
  • You grant SoulWish Tech a worldwide, non-exclusive, royalty-free license to host, store, process, reproduce, and display your content solely for operating, securing, and improving the Services.
  • You represent that you have all rights required to upload and share your content and that it does not violate third-party rights.

6. Moderation, Suspension & Termination

We may monitor, review, remove content, restrict features, suspend, or terminate accounts when needed for safety, policy enforcement, legal compliance, abuse prevention, or platform integrity.

We may act without prior notice where risk or legal urgency exists.

7. Privacy

Your use of the Services is also governed by our Privacy Policy, which explains how we collect and process personal data. By using the Services, you acknowledge our privacy practices.

8. Intellectual Property

  • All platform software, branding, design, text, and materials (excluding user content) are owned by SoulWish Tech or licensors.
  • You may not copy, modify, distribute, sell, license, or create derivative works from our materials without written permission.

9. Third-Party Services

The Services may link to or integrate third-party providers (e.g., app stores, auth providers, cloud/media services). We are not responsible for third-party platforms, their availability, or their terms.

10. Safety Disclaimer

You are solely responsible for your interactions with other users, whether online or offline. Always use caution and good judgment. We do not conduct guarantees of identity verification for every user and are not responsible for user behavior.

11. Service Availability

  • The Services are provided on an “as is” and “as available” basis.
  • We may update, modify, limit, or discontinue features at any time.
  • We do not guarantee uninterrupted, secure, or error-free operation.

12. Limitation of Liability

To the fullest extent permitted by law, SoulWish Tech and its directors, employees, affiliates, and partners are not liable for indirect, incidental, special, consequential, or punitive damages, including loss of data, profits, reputation, or opportunity arising from your use of the Services.

Our total liability for claims related to the Services shall not exceed the greater of: (a) amounts you paid to us (if any) in the previous 12 months, or (b) INR 1,000.

13. Indemnity

You agree to defend, indemnify, and hold harmless SoulWish Tech and its affiliates from claims, losses, liabilities, costs, and expenses arising from your content, your conduct, or your violation of these Terms or applicable law.

14. Termination by You

You may stop using the Services at any time and request account deletion, subject to legal and operational retention requirements.

15. Changes to Terms

We may update these Terms from time to time. Updated Terms become effective when posted with a revised “Last Updated” date. Continued use of the Services means you accept the revised Terms.

16. Governing Law & Jurisdiction

These Terms are governed by the laws of India. Courts located in [Your City, India] shall have exclusive jurisdiction, subject to applicable consumer protection laws.
